AEGISIFY USE-AT-YOUR-OWN-RISK, WARRANTY, ASSUMPTION OF RISK, AND LIMITATION OF LIABILITY DISCLAIMER

IMPORTANT LEGAL NOTICE: Please read this Disclaimer carefully before downloading, installing, activating, connecting, accessing, scanning with, subscribing to, purchasing, or otherwise using an Aegisify product, service, website, plugin, Agent, application, dashboard, API, report, recommendation, blog, documentation, public scan, or professional service.
This Disclaimer supplements the Aegisify Terms of Use, End User License Agreement, Privacy Policy, subscription terms, order forms, statements of work, and other applicable agreements. If a signed written agreement conflicts with this Disclaimer, the signed written agreement controls to the extent of the conflict.
1. AEGISIFY AND COVERED SERVICES
For purposes of this Disclaimer, “Aegisify,” “we,” “us,” or “our” means Aegisify, Inc., together with its applicable parent companies, subsidiaries, affiliates, successors, assigns, officers, directors, managers, members, shareholders, employees, contractors, developers, contributors, licensors, service providers, representatives, and agents.
“Products” or “Services” includes all current and future Aegisify offerings, whether provided free of charge, for a fee, as a trial, in beta, as a public service, or under a subscription. These offerings include, without limitation:
- Aegisify Audit and its SaaS dashboards, reports, risk summaries, and security-intelligence workflows;
- The Aegisify WordPress Agent and associated telemetry, security keys, local scanning, software inventory, code signals, configuration evidence, activity events, dependencies, and optional logs;
- Aegisify Shield and related hardening, administrator protection, file monitoring, access-control, malware, integrity, and security features;
- Aegisify WAF and related request inspection, threat scoring, blocking, allow-listing, bot, API, DDoS, traffic, and security-log functions;
- Aegisify Backup and related backup, database, restore, rollback, migration, transfer, retention, and disaster-recovery functions;
- Aegisify SEO and related SEO analysis, Search Console integration, metadata, schema, content, automation, indexing, AI, reporting, and remediation functions;
- Aegisify SiteMap and related XML sitemap, HTML sitemap, robots.txt, discovery, indexing, exclusion, and crawler-control functions;
- Aegisify Links and related short-link, redirect, internal-linking, campaign, click, analytics, WooCommerce, and link-health functions;
- Aegisify Spam or Spam Guard and related comment, form, registration, review, checkout, bot, and abuse-prevention functions;
- Aegisify Ticket, Aegisify SMTP, support, notification, delivery, and communication functions;
- License Manager and other licensing, activation, entitlement, subscription, domain, and update services;
- Public external scans, free scans, vulnerability checks, reports, downloadable materials, sample reports, demonstrations, and trial features;
- Aegisify websites, blogs, documentation, changelogs, recommendations, comparisons, educational materials, emails, APIs, and integrations; and
- Any update, replacement, successor, renamed, bundled, experimental, preview, beta, or future Aegisify product or service.
2. ACCEPTANCE AND AUTHORITY
By affirmatively clicking an “I Agree,” “Accept,” “Download,” “Install,” “Activate,” “Connect,” “Run Scan,” “Register,” “Subscribe,” “Purchase,” or similar button presented with notice of this Disclaimer, or by continuing to use a Product after receiving notice of it, you:
- Acknowledge that you have read and understood this Disclaimer;
- Agree to be legally bound by it;
- Accept the risks described in it;
- Confirm that you are legally capable of entering into this agreement;
- Represent that you have authority to bind yourself and any business, customer, employer, agency, organization, or other entity for which you act; and
- Represent that your use is lawful and authorized.
If you do not agree, do not download, install, activate, connect, access, scan with, purchase, subscribe to, or use the Products.
3. USE AT YOUR OWN RISK
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU DOWNLOAD, INSTALL, CONFIGURE, CONNECT, OPERATE, RELY ON, AND USE THE PRODUCTS ENTIRELY AT YOUR OWN RISK.
You acknowledge that WordPress software, security tools, firewalls, backups, remote services, artificial intelligence, APIs, hosting systems, third-party plugins, themes, integrations, databases, and internet-connected services involve inherent risks.
Those risks may include:
- Website outages, crashes, degraded performance, or temporary or permanent unavailability;
- Data corruption, alteration, deletion, duplication, loss, or unauthorized disclosure;
- Database, file, plugin, theme, configuration, or permission changes;
- Failed, incomplete, stale, corrupted, or unusable backups;
- Failed or incomplete restores, rollbacks, migrations, updates, or transfers;
- Security vulnerabilities, malware, compromise, unauthorized access, or data breaches;
- Failure to detect a threat, vulnerability, malicious file, configuration problem, unauthorized administrator, attack, or suspicious event;
- False positives, false negatives, inaccurate risk scores, or incorrect classifications;
- Blocking of legitimate users, administrators, customers, APIs, search crawlers, payment providers, applications, or business traffic;
- Failure to block malicious, automated, abusive, or unauthorized traffic;
- Account lockout, session termination, permission changes, or administrator-access restrictions;
- Compatibility conflicts involving WordPress, PHP, databases, hosting providers, servers, networks, themes, plugins, APIs, caching, content-delivery networks, or custom code;
- Loss of rankings, indexing, traffic, links, conversions, revenue, or search visibility;
- Incorrect metadata, schema, redirects, canonical tags, robots directives, sitemap entries, AI-discovery files, or indexing requests;
- Email delays, delivery failures, spam classification, lost messages, ticket failures, or notification failures;
- Expired, broken, incorrect, or redirected links;
- Incorrect, incomplete, misleading, outdated, or unavailable third-party information;
- Changes caused by updates, rollbacks, remote actions, feature changes, automation, or customer instructions; and
- Other technical, operational, security, financial, privacy, legal, or business consequences.
4. PRODUCTS REDUCE RISK; THEY DO NOT ELIMINATE RISK
Aegisify Products are intended to provide tools, evidence, visibility, recommendations, workflow support, and risk-reduction capabilities. They do not guarantee:
- Absolute or complete security;
- That a website will not be hacked, compromised, defaced, disrupted, or misused;
- Detection or prevention of every vulnerability, attack, exploit, malicious request, unauthorized account, malware infection, spam message, or security event;
- That every finding is accurate, current, complete, or applicable to your specific environment;
- That every legitimate request, user, administrator, integration, crawler, or customer will be allowed;
- That every malicious request, bot, attacker, or exploit attempt will be blocked;
- Successful backup, restore, rollback, replication, migration, transfer, or disaster recovery;
- Continuous operation, uninterrupted availability, error-free performance, or zero downtime;
- Compliance with GDPR, CCPA, HIPAA, PCI DSS, CMMC, FedRAMP, NIST, SOC 2, ISO, accessibility requirements, or any other law, regulation, framework, or contractual standard;
- Search-engine crawling, indexing, ranking, traffic, impressions, clicks, conversions, revenue, or inclusion in an Artificial Intelligence response;
- Email, ticket, alert, report, or notification delivery;
- Compatibility with every WordPress, PHP, server, database, hosting, plugin, theme, API, or third-party configuration; or
- Any specific legal, security, compliance, operational, SEO, marketing, financial, or business result.
No security product, firewall, scanner, backup system, AI system, recommendation, or WordPress plugin can eliminate all risk.
5. AUTHORIZED SYSTEMS AND SCANNING ONLY
You may use Aegisify scanning, Agent, Audit, WAF, security, vulnerability, code-analysis, diagnostic, monitoring, or testing features only on:
- A website, server, domain, network, application, database, account, or system you own; or
- A system for which you have explicit and sufficient authorization from the owner.
You must not use an Aegisify Product to access, test, monitor, scan, disrupt, interfere with, damage, investigate, or obtain information from a third-party system without authorization.
You are solely responsible for obtaining all permissions, customer approvals, employee notices, privacy disclosures, contractual rights, and legal authority required for a scan or connected service.
A public or external scan is limited by what can be observed through the available external interfaces. It is not a complete penetration test, legal compliance audit, code review, incident-response investigation, forensic examination, or guarantee that a website is secure.
6. AEGISIFY AGENT, TELEMETRY, LOGS, AND CUSTOMER DATA
When you install or connect the Aegisify WordPress Agent, you authorize supported technical information to be processed as described in the applicable settings, documentation, Terms, and Privacy Policy.
Depending on the features you enable, technical information may include:
- Domain and WordPress environment information;
- WordPress core, plugin, theme, package, version, activation, dependency, and update information;
- Configuration, user, administrator, access-control, security, activity, code, file, integrity, vulnerability, and exposure signals;
- Public routes, APIs, authentication surfaces, headers, redirects, certificates, and website responses;
- Scan status, errors, progress, findings, risk summaries, and reports;
- Optional WordPress, PHP, application, security, WAF, activity, debug, and diagnostic logs; and
- Information selected for AI-assisted analysis.
You acknowledge that logs, source files, URLs, headers, stack traces, database records, custom applications, plugins, themes, and support materials may contain Personal Information, confidential information, credentials, tokens, private paths, customer information, or other sensitive values.
You are responsible for:
- Reviewing and redacting information before transmission where appropriate;
- Disabling unnecessary debugging;
- Protecting Agent security keys, API keys, OAuth tokens, passwords, recovery keys, and credentials;
- Rotating any key or credential that may have been exposed;
- Obtaining a lawful basis, consent, or authorization to process information;
- Providing legally required privacy notices;
- Limiting telemetry to what is appropriate for your environment; and
- Complying with data-protection, employment, monitoring, confidentiality, and sector-specific requirements.
Do not submit passwords, private keys, authentication secrets, full payment-card data, protected health information, Controlled Unclassified Information, classified information, export-controlled information, biometric templates, or other highly regulated information unless Aegisify has expressly agreed in a signed written agreement to process that information.
7. ARTIFICIAL INTELLIGENCE DISCLAIMER
Aegisify may use Artificial Intelligence to summarize findings, identify possible relationships, reduce repetitive noise, rank or prioritize potential risks, analyze public content, explain technical evidence, and generate recommendations, reports, drafts, or remediation guidance.
Artificial Intelligence is probabilistic and may produce information that is:
- Incorrect;
- Incomplete;
- Misleading;
- Outdated;
- Duplicative;
- Inapplicable to your environment;
- Based on incomplete evidence; or
- Inconsistent with current law, security guidance, search-engine behavior, vendor documentation, or professional judgment.
AI-generated findings and recommendations are decision-support information only. They are not a substitute for review by an authorized WordPress administrator, developer, security professional, attorney, privacy professional, compliance professional, accountant, hosting provider, or other qualified adviser.
You are solely responsible for:
- Reviewing AI output;
- Confirming the underlying evidence;
- Testing recommendations;
- Determining whether a recommendation is appropriate;
- Approving or rejecting a proposed action;
- Maintaining backups and rollback procedures; and
- Accepting or remediating risk.
Do not deploy AI-generated code, settings, redirects, metadata, firewall rules, security changes, database changes, or other recommendations directly to production without appropriate review and testing.
8. SECURITY, WAF, SHIELD, AND ADMINISTRATOR-PROTECTION RISKS
Security and firewall rules can make incorrect decisions. Aegisify WAF, Aegisify Shield, and related security functions may:
- Block legitimate administrators, users, customers, bots, APIs, crawlers, payment systems, or integrations;
- Fail to block malicious activity;
- Generate false alerts or fail to generate an alert;
- Restrict, revoke, alter, or terminate access, roles, capabilities, or sessions;
- Increase resource use or affect website performance;
- Conflict with hosting-level security, CDN rules, proxies, caching, security plugins, themes, or custom applications; and
- Require manual configuration, allow-listing, investigation, rollback, or recovery.
You must monitor enforcement decisions, maintain emergency administrator access, review logs, test rules, preserve hosting access, and maintain a documented recovery procedure.
Aegisify is not a substitute for layered security, timely updates, secure hosting, strong passwords, multi-factor authentication, least privilege, vulnerability management, independent backups, monitoring, incident response, and professional review.
9. BACKUP, RESTORE, MIGRATION, AND DISASTER-RECOVERY RISKS
Aegisify Backup and related functions do not guarantee that a backup is complete, current, uncorrupted, accessible, restorable, or suitable for your recovery objective.
You are solely responsible for:
- Maintaining multiple independent backups;
- Keeping at least one backup separate from the production website;
- Protecting backup files, encryption keys, recovery links, and storage credentials;
- Confirming that files, database tables, fields, records, media, plugins, themes, and configuration data are included;
- Monitoring backup status and failures;
- Testing restoration regularly;
- Confirming recovery-point and recovery-time requirements;
- Reviewing overwrite, deletion, retention, and migration settings;
- Testing restores and migrations outside production where practical; and
- Maintaining a separate recovery plan if an Aegisify function is unavailable.
A restore, rollback, migration, synchronization, or overwrite action may replace newer information, remove changes, duplicate data, break integrations, alter URLs, change permissions, or render a website temporarily or permanently unavailable.
10. SEO, SITEMAP, ROBOTS, SCHEMA, LINK, AND SEARCH RISKS
SEO and search-engine outcomes depend on factors outside Aegisify’s control, including search-engine algorithms, crawler behavior, website quality, competition, user behavior, reputation, technical conditions, content, and third-party policies.
Aegisify does not guarantee:
- Search rankings;
- Indexing or continued indexing;
- Search traffic, impressions, clicks, leads, sales, or revenue;
- Inclusion in Google, Bing, ChatGPT, Gemini, Claude, Copilot, Perplexity, or any other search or AI service;
- Display of a particular title, description, schema result, rich result, citation, or answer;
- That a search engine will honor a sitemap, IndexNow request, robots directive, canonical tag, schema declaration, or indexing request; or
- That an SEO recommendation will improve performance.
Changes to robots.txt, noindex settings, canonicals, redirects, sitemaps, schema, metadata, URLs, links, internal-linking rules, or site structure may reduce visibility or cause pages to disappear from search results.
Short links, redirects, bulk linking, and automated internal-linking functions may create broken links, loops, incorrect destinations, unwanted links, campaign-reporting errors, or user-experience problems.
You must review, test, approve, monitor, and, where necessary, reverse SEO and link changes.
11. EMAIL, SMTP, TICKETING, ALERTS, AND NOTIFICATIONS
Aegisify does not guarantee that an email, ticket, security alert, scan notice, backup notice, renewal notice, report, or other communication will be delivered, received, opened, processed, or acted upon.
Delivery may be affected by:
- Spam filtering;
- Mail-server configuration;
- DNS records;
- Rate limits;
- Provider outages;
- Incorrect addresses;
- Authentication failures;
- Network conditions;
- Storage limitations; or
- Third-party policies.
You must not rely exclusively on email or alerts as your sole security-monitoring, backup-monitoring, renewal, or incident-response mechanism.
12. THIRD-PARTY SOFTWARE, SERVICES, AND INFORMATION
Aegisify Products may interact with or depend on WordPress, hosting providers, servers, databases, operating systems, themes, plugins, APIs, cloud providers, payment systems, email providers, storage providers, content-delivery networks, search engines, vulnerability databases, repositories, AI providers, analytics systems, and other third parties.
Aegisify does not own or control those third parties and is not responsible for:
- Their availability, security, privacy, accuracy, legality, quality, performance, compatibility, or continued operation;
- Their outages, delays, errors, policy changes, rate limits, access restrictions, security incidents, or discontinued services;
- Incorrect, incomplete, delayed, unavailable, or outdated third-party information;
- Third-party code, vulnerabilities, licenses, intellectual property, or conduct; or
- Losses caused by a third-party system or service.
Your use of third-party services is also governed by their respective agreements and privacy practices.
13. TESTING AND DEPLOYMENT RESPONSIBILITY
Aegisify Products are intended to be installed and managed by authorized administrators or professionals who understand WordPress, hosting, security, backups, databases, plugins, themes, and production change management.
Before using a Product in production, you should:
- Create and verify a complete independent backup;
- Test the Product in a staging or development environment;
- Confirm WordPress, PHP, database, theme, plugin, hosting, API, and server compatibility;
- Review permissions, telemetry, integrations, automation, and retention settings;
- Document a rollback and recovery procedure;
- Confirm administrator and hosting access;
- Review privacy and legal requirements;
- Monitor the website after deployment; and
- Confirm that responsible personnel can respond to an outage, lockout, false positive, failed restore, or security event.
You are solely responsible for deciding whether, when, where, and how to deploy or use a Product.
14. MODIFICATIONS, CUSTOM CODE, AND UNSUPPORTED ENVIRONMENTS
If you or a third party modifies, removes, renames, replaces, combines, redistributes, reverse engineers, patches, overrides, extends, or otherwise alters a Product or its files, settings, database records, security controls, API calls, or update mechanisms, you assume responsibility for the resulting consequences.
Nothing in this Disclaimer removes rights expressly granted under an applicable open-source license. However, Aegisify is not obligated to support, repair, investigate, update, secure, or maintain a modified, redistributed, forked, altered, unlicensed, unsupported, or unauthorized version.
Aegisify is not responsible for problems arising from:
- Custom code;
- Modified Product files;
- Removed or renamed files;
- Database edits;
- Third-party integrations;
- Unauthorized changes;
- Unsupported WordPress, PHP, database, server, browser, hosting, plugin, or theme versions;
- License circumvention;
- Incomplete installations or updates;
- Manual overrides;
- Failure to follow documentation; or
- Use outside the Product’s intended scope.
15. FREE, TRIAL, BETA, PREVIEW, AND EXPERIMENTAL FEATURES
Free, trial, beta, preview, experimental, evaluation, early-access, sample, and public-scan Products may be incomplete, changed frequently, limited, unavailable, discontinued, or subject to additional errors and risks.
Aegisify may, to the extent permitted by law:
- Modify or remove features;
- Change free or paid feature availability;
- Impose limits;
- Change compatibility requirements;
- End a trial or beta;
- Discontinue a Product;
- Require an update;
- Restrict access because of security, fraud, misuse, or license status; or
- Decline to provide backward compatibility.
Free, trial, beta, and preview Products should not be relied upon as the sole control for mission-critical, regulated, life-safety, emergency, medical, financial, public-safety, aviation, nuclear, industrial-control, or similarly high-risk operations.
16. BLOGS, DOCUMENTATION, REPORTS, AND RECOMMENDATIONS
Aegisify blogs, documentation, changelogs, help articles, marketing pages, comparisons, sample reports, risk scores, findings, recommendations, checklists, AI output, and educational information are provided for general informational and operational decision-support purposes.
They are not:
- Legal advice;
- Privacy advice;
- Compliance advice or certification;
- Tax or accounting advice;
- A formal penetration-test certification;
- A guarantee that a system is secure;
- A guarantee that a website is compliant;
- A guarantee of backup or recovery;
- A guarantee of SEO, marketing, traffic, revenue, or AI-search results;
- A binding roadmap or commitment to release a future feature; or
- A substitute for advice from an appropriately qualified professional.
Product descriptions, screenshots, demonstrations, roadmaps, changelogs, examples, and marketing statements may describe current, planned, limited, beta, or environment-dependent functions. Only an authorized written order form, statement of work, or signed agreement may create a binding product commitment.
17. SUPPORT AND PROFESSIONAL SERVICES
Free Products do not include guaranteed support, troubleshooting, response times, custom development, recovery assistance, compatibility work, or professional services.
Support for paid Products, if any, is limited to the support expressly included in the applicable active subscription, order form, or plan.
Standard support does not necessarily include:
- Custom debugging;
- Custom software development;
- Code review;
- Repair of modified files;
- Third-party plugin or theme conflicts;
- Hosting or server repair;
- Database recovery;
- Website migration;
- Performance tuning;
- Security incident response;
- Forensic investigation;
- Malware removal;
- SEO consulting;
- Legal or compliance analysis;
- Recovery from an unsupported modification; or
- Work outside the documented Product scope.
Unless Aegisify agrees otherwise in a written quote, order form, or statement of work, requested custom professional services are billed at:
- $100.00 USD per hour; and
- A four-hour minimum engagement.
Rates may be changed prospectively. No professional services begin until scope, payment, access, scheduling, and applicable terms have been agreed to in writing.
Professional services do not guarantee a successful repair, recovery, remediation, security result, ranking result, compatibility result, or business outcome.
18. CUSTOMER RESPONSIBILITIES
You are solely responsible for:
- Your website, users, customers, content, server, hosting environment, domain, network, application, database, files, and data;
- Your administrators, employees, agencies, developers, contractors, and service providers;
- Account, credential, security-key, API-key, OAuth-token, and password security;
- Creating, maintaining, protecting, and testing backups;
- Approving updates, fixes, rules, changes, restores, redirects, and deployments;
- Confirming compatibility;
- Reviewing reports, findings, recommendations, logs, and alerts;
- Determining whether a finding is accurate and applicable;
- Obtaining permission to scan or monitor a system;
- Providing privacy notices and obtaining consent;
- Compliance with laws, regulations, licenses, contracts, and third-party rights;
- Maintaining appropriate insurance;
- Maintaining independent business-continuity and incident-response procedures; and
- Using qualified professionals where the risk, complexity, or legal obligation requires them.
19. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” “WITH ALL FAULTS,” AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND.
AEGISIFY EXPRESSLY DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, SECURITY, AVAILABILITY, QUIET ENJOYMENT, PROFESSIONAL WORKMANSHIP, AND WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, TRADE USAGE, DOCUMENTATION, MARKETING, OR PRIOR COMMUNICATIONS.
Aegisify does not warrant that:
- A Product will meet your requirements;
- A Product will be uninterrupted, timely, secure, compatible, current, or error-free;
- Any error, defect, vulnerability, incompatibility, or security problem will be identified or corrected;
- Information or output will be accurate or complete;
- A recommendation will be safe or effective in your environment;
- A backup will be restorable;
- A security event will be prevented;
- A website will remain operational; or
- A specific result will be achieved.
No oral or written information from Aegisify creates a warranty unless expressly included in a signed written agreement by an authorized Aegisify representative.
20. ASSUMPTION OF RISK AND RELEASE
You knowingly and voluntarily accept the risks associated with downloading, installing, configuring, connecting, scanning with, relying on, and using the Products.
To the maximum extent permitted by applicable law, and particularly with respect to Products provided free of charge, you release the Aegisify protected parties from claims, losses, or damages arising from risks inherent in the Products or from ordinary negligence associated with providing or operating the Products.
This release does not apply to liability that applicable law does not permit to be released or limited.
21. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AEGISIFY AND THE OTHER AEGISIFY PROTECTED PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, ENHANCED, PUNITIVE, RELIANCE, COVER, OR CONSEQUENTIAL DAMAGES.
This exclusion includes, without limitation:
- Loss, corruption, alteration, disclosure, or destruction of data;
- Website crashes, downtime, service interruption, or business interruption;
- Security incidents, breaches, hacks, malware, spam, fraud, or unauthorized access;
- Loss of profits, sales, subscriptions, customers, goodwill, reputation, opportunities, anticipated savings, or revenue;
- Loss of rankings, traffic, indexing, impressions, clicks, links, conversions, or search visibility;
- Failed backups, restores, rollbacks, updates, migrations, or disaster recovery;
- Blocked legitimate traffic or unblocked malicious traffic;
- Account lockouts, unauthorized administrator accounts, access-control failures, or session changes;
- Costs of substitute products, services, hosting, recovery, investigation, data reconstruction, notification, remediation, or professional services;
- Third-party claims or regulatory investigations;
- Losses arising from AI output, reports, recommendations, or reliance on informational materials; and
- Any similar commercial, technical, security, privacy, legal, reputational, or operational loss.
This limitation applies regardless of the legal theory asserted, including contract, warranty, negligence, strict liability, tort, misrepresentation, restitution, statute, or otherwise, and even if Aegisify was advised that such damages were possible.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AEGISIFY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT, SERVICE, OR THIS DISCLAIMER SHALL NOT EXCEED:
- For a paid Product: the amount you paid directly to Aegisify for the affected Product during the twelve months immediately preceding the event giving rise to the claim; or
- For a Product provided free of charge: $100.00 USD.
The foregoing exclusions and limitations apply even if an exclusive or limited remedy fails of its essential purpose and reflect the allocation of risk between you and Aegisify.
22. NON-WAIVABLE RIGHTS
Nothing in this Disclaimer excludes, releases, or limits liability to the extent such exclusion, release, or limitation is prohibited by applicable law.
This includes liability that cannot lawfully be limited for fraud, willful misconduct, willful injury, gross negligence where non-waivable, violation of law, or other legally non-waivable conduct or rights.
Some jurisdictions do not allow certain warranty disclaimers, damages exclusions, releases, or liability limitations. In those jurisdictions, the affected provision applies only to the maximum extent legally permitted.

- Your website, server, application, database, domain, content, customers, users, or data;
- An unauthorized scan, test, investigation, or monitoring activity;
- Your violation of law, regulation, contract, license, privacy obligation, confidentiality obligation, or third-party right;
- Information, logs, files, content, code, or data you submit or make available;
- Your failure to obtain required authorization, consent, or permission;
- Your configuration, modification, integration, update, rollback, restore, deployment, or instruction;
- Custom code or third-party products;
- Your breach of this Disclaimer or another applicable agreement; or
- A claim by your customer, employee, contractor, user, visitor, business partner, regulator, or other third party.
Aegisify may assume control of the defense of a claim at your expense. You may not settle a claim in a manner that imposes liability, admission, payment, restriction, or obligation on an Aegisify protected party without Aegisify’s prior written consent.
24. EVENTS OUTSIDE AEGISIFY’S CONTROL
Aegisify is not responsible for delay, failure, interruption, or loss caused by events outside its reasonable control, including:
- Internet, hosting, cloud, network, DNS, certificate, power, or telecommunications failures;
- Cyberattacks, zero-day vulnerabilities, malware, ransomware, distributed denial-of-service attacks, or criminal conduct;
- Third-party outages or policy changes;
- Government actions, laws, sanctions, embargoes, or court orders;
- Natural disasters, fires, floods, earthquakes, epidemics, or severe weather;
- Labor disputes, civil unrest, terrorism, or war;
- Failures of WordPress, a hosting provider, a plugin, a theme, an API, an AI provider, a search engine, or another third party; or
- Customer actions, configurations, omissions, credentials, systems, or instructions.
25. PRODUCT CHANGES, UPDATES, AND DISCONTINUATION
Aegisify may release updates, fixes, changes, or enhancements and may modify, restrict, replace, suspend, or discontinue a Product or feature to the extent permitted by applicable law and contract.
Updates may affect compatibility, performance, interfaces, settings, workflows, stored information, integrations, reports, or available features. You are responsible for reviewing release information, maintaining backups, and testing updates.
26. NO PARTNERSHIP, FIDUCIARY DUTY, OR PROFESSIONAL RELATIONSHIP
Your use of a Product does not create a partnership, joint venture, agency, employment, fiduciary, attorney-client, accountant-client, auditor-client, managed-security-services, incident-response, or other professional relationship.
A professional relationship exists only if expressly established in a signed written agreement.
27. SEVERABILITY AND REFORMATION
If any provision of this Disclaimer is found invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted and, where legally permitted, modified only as much as necessary to make it enforceable.
The remaining provisions will remain in full force and effect.
28. GOVERNING TERMS
Governing law, jurisdiction, dispute-resolution procedures, claim requirements, and other contractual terms are established in the applicable Aegisify Terms of Use, End User License Agreement, subscription terms, order form, or signed agreement.
This Disclaimer should be read together with:
- The Aegisify Terms of Use;
- The Aegisify End User License Agreement;
- The Aegisify Privacy Policy;
- Applicable product documentation;
- Applicable subscription or order terms; and
- Any signed Data Processing Addendum or Statement of Work.

Aegisify may update this Disclaimer to reflect changes in Products, features, risks, third-party services, security practices, data practices, legal requirements, pricing, or business operations.
The revised Disclaimer will display an updated effective date. Where legally required or reasonably appropriate, Aegisify may provide additional notice through an account, dashboard, Product interface, website notice, update screen, download page, or email.
When affirmative acceptance is legally required, Aegisify may require you to accept the updated terms before continuing to use the affected Product.
